These Terms and Conditions govern access to the Aivexstore LTD website and purchases or service requests made through it. Please read them before submitting an order.

1. Acceptance of these terms

By accessing our website, creating an account, or placing an order, you agree to these terms and any policies expressly linked from them. If you do not agree, do not use the website or submit an order.

Nothing in these terms excludes, limits, or waives a right or remedy that cannot lawfully be excluded, limited, or waived under applicable consumer or other law.

2. Eligibility and account responsibility

You must have legal capacity to enter the relevant transaction. If you act for an organisation or another person, you confirm that you are authorised to do so.

You are responsible for providing accurate, current information; keeping account credentials confidential; and notifying us promptly if you suspect unauthorised access. You remain responsible for activity performed through your account unless applicable law provides otherwise.

3. Product and service information

We aim to describe products, services, prices, images, availability, and estimated fulfilment accurately. Display settings, supplier changes, or reasonable variations may affect how an item appears. A website error does not oblige us to supply on an incorrect basis where the law permits correction.

Please review the description, specifications, suitability, and any applicable warnings before ordering. Contact us if material information is unclear.

4. Orders and confirmation

Submitting an order is an offer to purchase. An on-screen acknowledgement, automated message, or payment instruction confirms receipt only; it does not by itself mean that Aivexstore has accepted the order.

Your order becomes binding only when Aivexstore confirms acceptance. We may reject or cancel an order before confirmation for reasons such as unavailability, suspected fraud, an obvious error, a legal restriction, or inability to fulfil the request.

If we cannot accept an order, we will notify you and handle any amount already paid as required by applicable law and our Refund Policy.

5. Prices, currency, charges, and payments

Prices are shown in the currency displayed at checkout. Before you submit an order, we will present the item or service price and any delivery, tax, or other charge known and applicable to that transaction. You are responsible for charges clearly disclosed before submission.

You must use a payment method you are authorised to use. Payments may be subject to validation by the relevant provider. We may delay confirmation or fulfilment until payment status is sufficiently verified. We do not ask you to disclose a full card PIN, mobile-money PIN, or one-time password to us.

6. Delivery and collection

Delivery or collection options, fees, and estimates will be communicated during the order process or in the order confirmation. Dates and times are estimates unless expressly agreed as binding.

You must provide an accurate contact number and delivery or collection information and ensure an authorised person can receive the order. Risk and ownership pass as provided by applicable law and the specific transaction terms. If delay, failed delivery, or unavailability occurs, we will communicate reasonable next steps and respect any mandatory remedies.

7. Cancellations, returns, and refunds

Cancellation, return, and refund eligibility depends on the reason, item or service, timing, condition, and mandatory legal rights. Our Refund Policy explains the process, statutory cancellation provisions for eligible electronic transactions, exceptions, and remedies for wrong, damaged, defective, unsafe, or materially misdescribed items.

8. Acceptable use and security

You must not misuse the website. Prohibited conduct includes attempting unauthorised access; introducing malware; disrupting service; scraping or automated extraction that burdens the service; impersonating another person; submitting fraudulent orders; bypassing security controls; or using the website for unlawful, harmful, or abusive activity.

We may use reasonable measures to prevent fraud and protect customers, staff, and systems. Please report suspected website or account security issues to the contact below.

9. Intellectual property

The website's original text, branding, layout, software, graphics, and other content are owned by or licensed to Aivexstore unless stated otherwise. You may use the website for personal, lawful shopping and information purposes. You may not reproduce, modify, distribute, sell, or commercially exploit protected content without permission or another lawful basis.

10. Third-party services and links

The website may depend on or link to third-party services, such as payment, communications, maps, hosting, or delivery services. Their own terms and privacy practices may apply when you interact with them. We do not control independent third-party websites, but this does not remove any responsibility Aivexstore has under mandatory law for its own conduct or suppliers acting on its behalf.

11. Disclaimers and limitation of liability

We take reasonable steps to keep the website available and information accurate, but do not promise uninterrupted, error-free access or that every item will always remain available. To the fullest extent permitted by law, implied terms are limited only where lawful.

To the fullest extent permitted by law, Aivexstore is not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was made. Any limitation applies only so far as the law allows. Nothing limits liability for fraud, wilful misconduct, death or personal injury caused by negligence where it cannot be limited, or any other liability or consumer remedy that cannot lawfully be excluded.

12. Suspension and termination

We may restrict or suspend access where reasonably necessary to protect security, investigate suspected misuse or fraud, comply with law, maintain the service, or address a material breach. Where appropriate and lawful, we will provide notice and a reasonable opportunity to respond. Suspension does not remove rights or obligations already accrued.

13. Changes to these terms

We may update these terms to reflect changes in law, operations, services, or risk. The updated version will be posted with a revised date. Changes apply prospectively unless the law requires otherwise; the terms accepted for an already confirmed order continue to govern that order unless a lawful change is agreed.

14. Governing law, disputes, and severability

These terms are governed by the laws of the United Republic of Tanzania. If a concern arises, please contact us first so we can try to resolve it promptly. You may also use any regulator, tribunal, court, alternative dispute process, or consumer remedy available to you under applicable law.

If any provision is held invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
